Documents required to be checked before buying a flat in Guwahati

Before buying a flat in Guwahati, or anywhere in Assam, it is always important to have the documents of the property verified by legal professionals in Guwahati.
Legal professionals will check the accuracy of the documents and make sure the seller explains clearly how much land area the buyer will own after purchasing the flat.
It is important to check specific legal and regulatory documents to ensure the property is legal, free from disputes, and follows local rules.
Here is a list of documents to be checked before buying a flat in Guwahati:
**Title Deed / Sale Deed:** Confirm that the document is in the seller’s name and that the seller’s name is listed in the Jamabandi.
If the flat is built by a developer, check the Power of Attorney and Development Agreement between the seller and the builder.
**Always get a certified copy of the Title Deed to confirm it is real.
**
**Jamabandi Certificate:** Check if the seller’s name is listed here, how much land area is registered in the seller’s name, and whether the land is khiraj myadi or not.
Also, check the class and type of land.
**Mutation Certificate:** This proves that the land has been transferred to the seller’s name and when that happened.
**Building Permission / Construction Approval:** In Guwahati, citizens need to get a “No Objection Certificate” (NOC) for building RCC structures, as constructing such buildings falls under the area of the Guwahati Metropolitan Development Authority (GMDA).
The process involves getting a Planning Permit from GMDA, which then forwards the proposal to the Guwahati Municipal Corporation (GMC), which gives the Building Permit to start construction.
**Occupancy Certificate:** This is a document that confirms the building is safe and ready to be used.
It is issued after the construction is finished and inspected.
**Completion Certificate:** This certifies that the construction follows the approved plans and meets local building standards.
**Encumbrance Certificate (EC):** This shows if there are any legal issues, like unpaid dues or mortgages, against the property.
It is issued by the Sub-Registrar’s Office in Kamrup Metro.
**No Objection Certificates (NOCs):** These are needed from various departments like GMDA/GMC, Pollution Control Board, Fire Department, and Water and Electricity Board.
**Approved Layout Plan:** This layout plan should be available from either the GMDA or the builder.
**RERA Registration (if applicable):** Check if the project is registered with the RERA Assam.
Projects that are larger than 500 square meters or have more than eight apartments must be registered with RERA.
**Bank NOC (if under loan):** If the builder took a loan for the project, get a No Objection Certificate from the bank.
**FORM-50:** Get this from the District Civil Court to check if there are any legal cases or disputes related to the property.
